CONSUMER RIGHTS – RIGHT OF WITHDRAWAL – CANCELLATION & RETURN CONDITIONS

 

 

GENERAL

 

When you place an order electronically through our website, you are deemed to have accepted the preliminary information form and the distance sales agreement provided to you.

 

Buyers are subject to the provisions of the Law No. 6502 on the Protection of Consumers, the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188), and other applicable legislation in force regarding the sale and delivery of the purchased product.

 

Shipping costs (delivery expenses) belong to the Buyer.

 

Each purchased product shall be delivered to the person and/or organization at the address indicated by the Buyer within 30 days at the latest, provided that this period is not exceeded. If the product cannot be delivered within this period, the Buyer may terminate the agreement.

 

The purchased product must be delivered complete, in accordance with the specifications stated in the order, and with documents such as warranty certificate and user manual, if any.

 

In case it becomes impossible to sell the purchased product, the Seller must notify the Buyer in writing within 3 days from the date of learning of this situation, and the total amount must be refunded to the Buyer within 14 days.

 


 

IF THE PURCHASE PRICE IS NOT PAID

 

If the Buyer does not pay for the purchased product or cancels the payment in the bank records, the Seller’s obligation to deliver the product shall cease.

 


 

UNAUTHORIZED USE OF CREDIT CARD

 

After delivery of the product, if it is determined that the credit card used for payment by the Buyer has been unfairly used by unauthorized persons and the product price is not paid to the Seller by the relevant bank or financial institution, the Buyer must return the product to the Seller within 3 days, with shipping costs borne by the Seller.

 


 

NON-DELIVERY DUE TO UNFORESEEN CIRCUMSTANCES

 

If unforeseen force majeure events occur and the product cannot be delivered on time, the Buyer shall be informed. The Buyer may request cancellation of the order, replacement of the product with a similar one, or postponement of delivery until the obstacle is removed.

 

If the Buyer cancels the order:

 

  • If the payment was made in cash, the amount shall be refunded to the Buyer in cash within 14 days.

  • If the payment was made by credit card, the refund shall be made to the bank within 14 days of cancellation. However, the bank may reflect the amount to the Buyer’s account within 2–3 weeks, and the Seller cannot be held responsible for delays caused by the bank.

 


 

BUYER’S OBLIGATION TO INSPECT THE PRODUCT

 

The Buyer shall inspect the goods/services subject to the agreement before taking delivery; damaged and defective goods/services such as dented, broken, torn packaging shall not be accepted from the courier company. Goods/services accepted from the courier shall be deemed undamaged and intact.

 

After delivery, the Buyer is responsible for preserving the goods/services with due care. If the right of withdrawal is to be exercised, the goods/services must not be used. The invoice must also be returned with the product.

 


 

RIGHT OF WITHDRAWAL

 

The Buyer may exercise the right of withdrawal, without any legal or penal liability and without providing any justification, by rejecting the goods within 14 (fourteen) days from the delivery date to themselves or the person/organization they designate, provided that they notify the Seller through the contact details below.

DURATION OF THE RIGHT OF WITHDRAWAL

 

If the purchased item is a service, the 14-day period begins on the date the contract is signed. In service contracts where performance begins with the consumer’s approval before the withdrawal period expires, the right of withdrawal cannot be exercised.

 

Costs arising from the exercise of the right of withdrawal shall be borne by the Seller.

 

To exercise the right of withdrawal, the Buyer must send a written notice by registered mail with return receipt, fax, or e-mail within 14 (fourteen) days, and the product must remain unused in accordance with the provisions of “Products for Which the Right of Withdrawal Cannot Be Exercised.”

 


 

EXERCISE OF THE RIGHT OF WITHDRAWAL

 

  • The invoice of the product delivered to the Buyer or a third party (If the invoice is corporate, the return must be made with a return invoice issued by the institution. Returns of orders invoiced to institutions cannot be completed without a return invoice.)

  • Return form

  • Products to be returned must be delivered complete and undamaged, together with their packaging, box, and any standard accessories.

 


 

RETURN CONDITIONS

 

The Seller is obliged to refund the total price and return any documents that place the Buyer under obligation within 10 days from receipt of the withdrawal notice, and to receive the goods back within 20 days.

 

If the decrease in value of the goods is due to the Buyer’s fault or if return becomes impossible, the Buyer shall be liable to compensate the Seller’s damages to the extent of their fault. However, the Buyer is not responsible for changes or deterioration due to proper use of the goods during the withdrawal period.

 

If the exercise of the right of withdrawal causes the order total to fall below the campaign limit set by the Seller, the discount obtained within the scope of the campaign shall be canceled.

 


 

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

 

Products prepared according to the Buyer’s request or clearly tailored to their personal needs, products not suitable for return, underwear bottoms, swimwear bottoms, cosmetics, make-up products, disposable products, perishable goods or goods with a potential expiration date, products that are not suitable for return for health and hygiene reasons once the packaging is opened by the Buyer after delivery, products mixed with other items and impossible to separate by nature, periodicals such as newspapers and magazines other than those provided under a subscription agreement, electronic services performed instantly or intangible goods delivered instantly to the consumer, and sound or video recordings, books, digital content, software programs, data recording and storage devices, computer consumables where the packaging has been opened by the Buyer, cannot be returned as per the Regulation.

 

For cosmetics, personal care products, underwear, swimwear, books, reproducible software and programs, DVDs, VCDs, CDs, cassettes, and stationery consumables (toner, cartridge, ribbon, etc.), returns are only possible if their packaging is unopened, untested, undamaged, and unused.

 


 

DEFAULT AND LEGAL CONSEQUENCES

 

If the Buyer defaults on payments made by credit card, they agree, declare, and undertake to pay interest under the credit card agreement signed with the card-issuing bank and to be responsible to the bank. In such a case, the relevant bank may initiate legal proceedings; the Buyer shall be liable for the expenses and attorney’s fees incurred. In any case, if the Buyer defaults on their debt, the Buyer agrees to compensate the Seller for damages and losses caused by the delayed performance of the debt.
